Bluenose Law guides families through Guardianship and Trusteeship processes, providing expert support every step of the way.
Guardianship
A Guardian makes key decisions for an adult who cannot do so, including healthcare, living arrangements, and activities. However, financial matters require a separate Trusteeship appointment. Often, one person serves as both Guardian and Trustee.
Trusteeship
A Trustee manages finances for an incapacitated adult, handling income, expenses, leases, contracts, and tax filings. Their authority is strictly financial, ensuring responsible management of the adult’s assets.
Trust Accounting
Adult Trustees must periodically submit financial records for court approval, with review frequency varying by case. In some situations, it may be possible to reduce these court reviews.
Guardianship & Trusteeship Disputes
All immediate family members must be notified when applying for Guardianship or Trusteeship, which can sometimes lead to disputes over who should take on these roles. Open discussions early in the process can help prevent conflicts, streamline proceedings, and avoid unnecessary court interventions.

Frequently Asked Questions
Questions about Estate Planning? We will work with you to plan for the future health and financial well being of your most valuable assets - your family.
Can i leave my Estates to whoever I want to?
As long as the property is self-acquired, you can leave it to whomsoever you wish through a will. However, it will be better to mention in the will the reason you do not want to give it to one of your children as it will reduce the chances of the will being contested by him or her.
